Clayman Rosenberg Kirshner & Linder LLP maintains an active civil and criminal appellate and post-conviction practice in state and federal courts throughout the country.  Our attorneys argued the first post-Skilling “honest services” appeal before the United States Court of Appeals for the Second Circuit.  We have represented a major New York banking institution appealing a tax assessment by New York City before the Supreme Court of the State of New York, Appellate Division, First Department.

  • Representing a client in a post-trial appeal before the New York Court of Appeals and the Appellate Division, First Department, from a conviction on first-degree assault charges.

  • Working with the United States District Court for the Southern District of New York in an initiative to identify defendants convicted of drug offenses who may be eligible for sentence reductions.

  • Obtaining a favorable appellate decision in complex litigation concerning ownership of a multi-million-dollar diamond.

  • Prevailing on appeal in an insurance coverage dispute and securing full indemnification for a defrauded business.

  • Prevailing on appeal in an insurance coverage dispute and obtaining coverage for a business after its broker had stolen the premium.

  • Handling an appeal addressing the Securities and Exchange Commission’s statutory authority to obtain disgorgement from relief defendants.

  • Prevailing on appeal in securing dismissal of a claim against an insurance brokerage.
