Biography

Eliel A. Talo represents individuals and businesses in civil and criminal matters in New York state and federal courts. His practice includes criminal defense, commercial disputes, employment litigation, judgment enforcement, criminal appeals, regulatory and tax investigations, and matters involving allegations of sexual misconduct.

He has experience at each stage of litigation, from factual investigation and motion practice through trial preparation, trial support, sentencing, and appeal. He has represented clients in matters involving bank fraud, criminal tax investigations, employment disputes, Child Victims Act and Adult Survivors Act claims, and parallel civil and criminal exposure. He works with clients facing matters where legal, professional, business and reputational consequences often intersect.

In 2023, Eliel was a member of the trial team that secured a not-guilty verdict in New York State Supreme Court for an attorney charged in an official-misconduct case. He has also been part of defense teams that secured dismissals in serious criminal matters, including sexual-misconduct and felony-assault allegations, after factual investigations identified evidence undermining the prosecution’s theory.

Prior to joining Clayman Rosenberg Kirshner & Linder LLP in 2020, he served as a law clerk to the Honorable Jack M. Sabatino, Presiding Judge of the New Jersey Superior Court, Appellate Division.

Eliel has been selected to the New York Metro Rising Stars list by Super Lawyers each year since 2023.

  • As a member of the trial team, helped secure a not-guilty verdict for an attorney charged as an accomplice to official misconduct in a New York State Supreme Court criminal trial.
  • As part of a defense team, secured dismissal of felony assault charges filed by the Manhattan District Attorney’s Office against a prominent chef after analysis of surveillance footage undermined the allegations.
  • As part of a defense team, secured dismissal of sexual-misconduct charges filed by the Manhattan District Attorney’s Office against a physician after investigation identified evidence undermining the allegations.
  • Represented clients in Child Victims Act and Adult Survivors Act lawsuits.
  • Represented clients in labor and employment disputes involving breach-of-contract, wage-and-hour, and discrimination claims.
  • Obtained dismissal of multiple statutory labor and wage claims in an employment dispute in New York State Supreme Court.
  • Negotiated settlement of a discrimination claim against a Fortune 500 employer.
  • Represented clients in federal regulatory and criminal tax investigations.
    Secured dismissals of criminal matters in New York, Kings, and Westchester Counties based on violations of New York’s speedy-trial and discovery laws.
  • Represented clients in criminal matters in New York, Kings, Bronx, Dutchess, and Columbia Counties.
  • Represented a client accused of participating in a scheme to fraudulently obtain a bank loan, obtaining a sentence well below the agreed-upon Sentencing Guidelines range.
  • Represented a diamond dealer in judgment-enforcement proceedings involving a multi-million-dollar debt.
