

Partners Brian Linder and Effie Blassberger published a New York Law Journal article on Feb. 3 that covers recent changes to New York City’s Gender Motivated Violence Act (GMVA).
On Jan. 29, the New York City Council overrode a veto from former mayor Eric Adams to amend the GMVA by adding a new civil cause of action for gender-motivated violence that occurred prior to 2022, while providing a new 18-month filing window.
Linder and Blassberger cover the history of the GMVA, which was enacted in 2000, and the 2022 amendments that set the stage for this latest round of legislation. They provide an overview of ongoing litigatio
n related to the GMVA’s 2022 amendments and whether those changes are preempted by New York State’s Adult Survivors Act (ASA) and Child Victims Act (CVA). The article concludes with an analysis of the core features of the 2026 amendments.
“The newly created cause of action applies to conduct that would otherwise be time-barred and authorizes civil claims based on historical conduct that could not have been brought prior to the amendment’s enactment,” Linder and Blassberger write.
