Just days before trial, partner James Valentino, along with co-counsel Brian Heller and Davida Perry of Schwartz, Perry and Heller LLP, secured a settlement for a former investment banking analyst who alleged she was unlawfully fired by Centerview Partners because of a disability.
A key issue in the litigation was whether being available for long, unpredictable hours in the middle of the night was an essential function of an investment banking analyst’s role. Valentino’s client requested an accommodation to have a break for sleep during overnight hours to alleviate a diagnosed anxiety disorder. Centerview initially accommodated her, but terminated her shortly afterward, stating that no reasonable accommodation would have allowed her to perform the essential functions of the role, the Wall Street Journal reported.
