CRKL managing partner Thomas C. Rotko secured the dismissal of a family offense petition against his client after a bench trial in New York County Family Court. The petitioner sought an order of protection and accused Rotko’s client of assault, stalking and harassment. On Oct. 8, the court found that no family offense occurred and dismissed the petition with prejudice.
In announcing the verdict, the court noted that Rotko’s cross-examination established that the petitioner did not present the full communications between the parties and was not a credible witness. The defense was successful in part because Rotko assembled years of text communications, photographs and video evidence to demonstrate that no family offense was committed.
Rotko is CRKL’s managing partner and a former assistant district attorney in the Manhattan District Attorney’s Office, where he served in the Trial Division and the Official Corruption Unit. He represents clients in criminal defense matters and regulatory investigations.
