Partner James Valentino recently spoke with Bloomberg News about a controversial bill making its way through Florida’s legislature that would allow four-year non-compete restrictions in contracts with people earning at least double the average local wage — typically more than $140,000 in urban areas. If passed, the bill would also accelerate court orders blocking defectors from performing similar work elsewhere or barring competitors from hiring them.
Non-competes are already allowed in Florida, but the rules aren’t as clear, giving judges leeway to interpret whether the term and scope of clauses are reasonable. Under this new bill, the rules would become far more advantageous to employers seeking to prevent employees from joining competitors.
According to Valentino, Florida is “extremely friendly toward employers.” However, he noted that this bill “takes it to a different level.”
