New York maintains one of the nation’s strongest and most comprehensive Paid Family Leave policies. First established in 2016, these laws ensure that families would not have to put their financial security at risk to care for a newborn.

The team recently resolved a case for a high-ranking female executive who was demoted during her maternity leave. Arguing that the company’s demotion was discriminatory, Hinkle and Valentino were able to negotiate a substantial pre-litigation settlement.
As of January 1, 2025, workers in New York State who are pregnant may also be eligible for additional time off for prenatal care. Under this new law, any privately-employed pregnant New Yorker will be able to receive an additional 20 hours of paid sick leave for prenatal care in addition to their existing sick leave, ensuring they can receive the care they need without putting their employment at risk.
