Clayman Rosenberg Kirshner & Linder LLP partners Wayne E. Gosnell and Isabelle A. Kirshner secured the dismissal of three assault charges against Nassadir Tate stemming from a March 14 encounter on a Penn Station subway platform.

After reviewing surveillance footage, witness interviews, the autopsy report and Tate’s Mirandized statement, the Manhattan District Attorney’s Office moved to dismiss all three assault charges, concluding it could not disprove beyond a reasonable doubt that Tate’s actions were legally justified.

“Mr. Tate was placed in an extremely dangerous situation where he was almost pushed onto the subway tracks, and he was threatened repeatedly,” Gosnell told The Daily Mail. “He defended himself just as anyone would have. He fully cooperated with the police, and we are thrilled that his innocence has now been acknowledged in open court by the prosecutors.”
