Partner Effie Blassberger and associate Thomas Dollar recently co-authored an article in Capitalism Today examining America’s conflicting and conflicted views toward the “#MeToo” movement since the October 2017 revelations about Harvey Weinstein’s sexual misconduct came to light.
The authors note that in the years since the initial reporting on Weinstein, it has become common to speak about a “post-#MeToo era” in which formerly “canceled” men have returned to the halls of power and women’s personal stories of harassment or abuse are no longer met with the same level of sympathy and solidarity. But the reality is far more complex and nuanced.
As attorneys who represent both plaintiffs and defendants in high-profiles sexual harassment cases, Blassberger and Dollar write from their unique vantage point, describing the shift away from impassioned reactions which quickly “canceled” the accused without a full and fair process, toward a more considered approach that still allows accusers a process to be heard. A review of some recent cases illustrates how workplace misconduct and accountability have evolved since 2017 and how these developments have impacted corporate legal exposure and reputational risk.
