Clayman Rosenberg Kirshner & Linder LLP partner Wayne Gosnell, managing partner Tom Rotko and chairman Charles Clayman helped a New York City psychiatrist avoid jail time in an investigation that began following the death of Maura Mandt, an ESPN producer, in 2020.
In a 43-count indictment, prosecutors alleged that Dr. Marianne Gillow illegally wrote prescriptions for Mandt. Gillow treated Mandt for many years and prescribed opioids as the only viable treatment for Mandt’s chronic pain management. Prosecutors also alleged Gillow illegally wrote prescriptions for Mandt’s assistant so that he could deliver them to the producer.
Clayman attorneys focused their defense on a medical examiner’s determination that opioids were not a cause or a contributing factor in the producer’s death, which was attributed to heart disease complications.
Gillow pleaded guilty to two counts related to writing a prescription for Mandt’s assistant, but maintained her innocence as to any counts related directly to Mandt. She received a conditional discharge and no jail time.
