Kirshner and Rotko Secure Dismissal of Rape Charge Against NYU Student

Partners Isabelle Kirshner and Tom Rotko recently secured the dismissal of rape charges against a 22-year-old New York University student. Prosecutors dropped the most serious charges in late September after revealing that they could not prove the claims made by the female accuser.  The case is still pending.

Details of the incident surfaced in June of this year when the male student was arrested and charged with both rape and strangulation. According to the complaint, a woman claimed the incident happened in January 2024 inside a building on East 12th Street.

The student pleaded not guilty to both charges and had been released on bail.

“We are grateful that the D.A.’s office has chosen to carefully scrutinize the evidence in this matter and to dismiss a charge that could not be sustained,” Kirshner told the New York Times.
