Partners Isabelle Kirshner, Brian Linder, and Effie Blassberger successfully secured a dismissal for real estate executives Alon and Oren Alexander in a recent civil case involving the brothers. The high-profile decision was reported in The New York Times.
In his January 22, 2025 decision, Judge Lewis A. Kaplan of the Southern District of New York dismissed Angelica Parker’s civil lawsuit against the Alexander brothers, and fully adopted the arguments set forth in the Alexanders’ motion to dismiss.
In their motion to dismiss, attorneys Kirshner, Linder and Blassberger argued that the deadline to revive expired claims in New York City’s Victims of Gender-Motivated Violence Protection Law was inconsistent with, and therefore preempted by, the deadline in New York State’s Adult Survivors Act. As such, any lawsuit to revive claims that had otherwise expired should have been brought before the Adult Survivors Act window closed in November 2023 and Plaintiff’s claims were therefore time-barred.
