Rotko, Kirshner and Dollar Secure Rare Dismissal In Attempted First Degree Murder Charge

Last month, partners Thomas Rotko, Isabelle Kirshner, and associate Thomas Dollar, convinced the New York County District Attorney’s Office to dismiss all charges against our client accused of shoving a man into a moving subway train.

The client was accused of attempted murder and assault in the first degree. After a thorough review of extensive video recordings, among other things, Mr. Rotko, Ms. Kirshner, and Mr. Dollar persuaded the District Attorney’s Office that there was insufficient evidence to proceed with any charges. This was a particularly difficult result to obtain in light of the increase in crime in the subway system.

Against that backdrop, our attorneys ensured that the District Attorney’s Office focused on the facts of this case and the elements of the offenses.
